Civil servants and border crossing: who has the right to leave

General mobilization and martial law are in force in Ukraine. During it, only certain categories of persons liable for military service can go abroad. We tell which of the civil servants has such an opportunity.

Vladislav Yurchak, a lawyer at T&T Partners, helped shed light on this issue. He told whether civil servants can cross the border during martial law.

Can civil servants go abroad

According to the lawyer, the mobilization reservation applies to civil servants. He noted that the current legislation defines a fairly wide range of officials who have the opportunity to leave Ukraine. Here is the list:

  • members of the Cabinet of Ministers of Ukraine, first deputies and deputy ministers;
  • heads of central executive bodies, their first deputies and deputies;
  • State Secretary of the Cabinet of Ministers of Ukraine, his first deputy and deputies;
  • Head of the Administration of the Verkhovna Rada of Ukraine, his first deputy and deputies;
  • state secretaries of ministries;
  • Head of the Office of the President of Ukraine and his deputies;
  • heads of other subsidiary bodies and services formed by the President of Ukraine and their deputies;
  • Chairman of the Security Service, his first deputy and deputies;
  • Chairman and members of the National Council for Television and Radio Broadcasting;
  • Chairman and members of the Accounts Chamber;
  • Chairman and members of the Central Election Commission;
  • chairmen and members of other state collegial bodies;
  • Secretary of the National Security and Defense Council of Ukraine, his first deputy;
  • people's deputies of Ukraine;
  • Commissioner of the Verkhovna Rada of Ukraine for Human Rights and his representatives;
  • Chairman of the National Bank, his first deputy and deputies;
  • Permanent Representative of the President of Ukraine in the Autonomous Republic of Crimea and his deputies;
  • chairmen of local state administrations, their first deputies and deputies;
  • judges of the Constitutional Court of Ukraine;
  • judges;
  • prosecutors;
  • heads of other state bodies and their deputies;
  • deputies of local councils;
  • heads of structural subdivisions of state bodies and local self-government bodies;
  • employees booked for the period of mobilization and wartime by state authorities, other state bodies, local governments;
  • heads of state unitary enterprises and their deputies;
  • the chairman and members of the executive bodies of economic companies, in the authorized capital of which 50 percent or more of shares (stakes) belong to the state;
  • the head and members of the executive bodies of business companies, in the authorized capital of which 50 percent or more of shares (stakes) belong to business companies, in which the state's share is 100 percent, including subsidiaries.

It should be noted that on January 23, Vladimir Zelensky issued a decree. It involves a ban on officials and deputies from leaving Ukraine without confirmation of an official business trip.

This decree was preceded by trips of people's deputies and officials abroad on vacation, which they disguised as working visits. This decree caused a wave of indignation, because it also offended women who, during martial law, could freely cross the state border.
