Google's refusal to localize Russians' data goes to court

Moscow. July 1. INTERFAX.RU – The Magistrates' Court of the Tagansky District of Moscow has registered material about an administrative offense against Google, according to which the company faces a fine of up to 6 million rubles for refusing to localize the data of Russians in Russia. Interfax was informed about this in court.

The date for consideration of the minutes has not yet been set.

Roskomnadzor reported on June 30 that it had drawn up an administrative protocol on Google under Part 8 of Art. 13.11 Administrative Code (Violation of Russian legislation in the field of personal data). The department noted that the company's management could not confirm the fact of the localization of databases of Russian users in Russia.

The RKN also said that they were expecting Twitter and Facebook to respond to the request for the localization of the databases of Russian users, after which they would decide whether to draw up similar protocols for them.

If Google is fined, it will be the first fine for the company for failing to comply with the requirements of the law on data localization of Russians. Prior to that, the company was fined a total of 9.5 million rubles under the protocols drawn up by the RKN on non-removal of content prohibited in Russia. Protocols remain in court, according to which the company can be fined tens of millions more.

Google was also fined for refusing to filter search results for prohibited content.

On May 26, Deputy Head of Roskomnadzor Milos Wagner said that Facebook, Twitter and a number of other social networks must report on the localization of databases of Russian users by July 1, otherwise they face fines of up to 18 million rubles.

In Russia, the LinkedIn social network has already been blocked for violating the localization requirement. In 2016, the Tagansky Court of Moscow satisfied the corresponding claim of Roskomnadzor. The issue of localizing data of Russian citizens on the territory of the Russian Federation by social networks Facebook and Twitter has been discussed with companies since 2015.
