Mobilization in Ukraine: how military records are checked at enterprises

Martial law and mobilization continues in Ukraine due to a full-scale Russian invasion. During martial law, enterprises are required to keep military records.

At the request of Channel 24, Vladislav Yurchak, a lawyer at the T&T Partners law firm, explained how military records are checked at enterprises in Ukraine.

The tasks of inspections are assigned to TCC and JV

The lawyer explained that, according to Cabinet Decree No. 1487, all enterprises will be checked for military records. This task was entrusted to the TCC and the joint venture.

The procedure for conducting audits on accounting provides for advance (not later than 10 days before the start of the audit) informing the heads of enterprises about:

  • the presence of those responsible for military accounting and ownership of military accounting;
  • labor discipline in hiring and dismissal and compliance with the information of the TCC and the joint venture;
  • the state of ensuring the notification and arrival of conscripts, those liable for military service and reservists to the relevant TCCs and SPs;
  • organization, status and results of reconciliation of accounting data for TCC and JV;
  • the state of bringing to the conscripts, persons liable for military service and reservists the Rules of Military Records under a personal signature and control over their execution;
  • organization and condition of booking of persons liable for military service working at the enterprise;
  • organization and results of the elimination of deficiencies identified during preliminary checks of the state of military records.

Violations of the legislation on defense, mobilization preparation and mobilization provide for the imposition of an administrative fine on officials (depending on the level of violation – from 3,400 to 8,500 hryvnias).

Mobilization in Ukraine: Essentials

After the full-scale invasion of Russia on the territory of Ukraine, martial law was declared, established for a certain period and continuing as needed.

Due to the fact that the war continued, the Verkhovna Rada for the sixth time approved the extension of martial law for 90 days and announced general mobilization from February 19, 2023 for the next 3 months – until May 20, 2023.

Persons liable for military service at the age of 18-60 are subject to mobilization. Also, due to martial law, those liable for military service are prohibited from traveling abroad.
